These Terms of Use ("Terms") are a binding agreement between you and PEP Social, LLC ("PEP Social", "we", "us", or "our") and govern your access to and use of the PEP Social mobile application, our website at pepsocialapp.com, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Please read Section 24 (Dispute Resolution & Arbitration) and Section 18 (Time limit for claims) carefully. Section 24 requires most disputes to be resolved by binding individual arbitration and waives your right to a jury trial and to participate in a class action. Section 18 requires claims to be brought within one year.

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time (see Section 30); your continued use after an update means you accept the revised Terms.

3. Eligibility & age

You must be at least 18 years old and able to form a binding contract to use the Service. PEP Social is intended for adults only. By using the Service, you represent and warrant that you meet these requirements. If we learn that a user is under 18, we may suspend or delete the account.

4. Health, peptide & safety disclaimer

PEP Social is a social and informational platform only. All content in the Service — including posts, ratings, comments, and AI-generated responses — is provided for general educational and discussion purposes and is not medical advice, diagnosis, treatment, or a recommendation. It is not a substitute for professional medical guidance.

No doctor–patient relationship is created by your use of the Service, by contacting us, or by any interaction with other users or the AI assistant. We are not a healthcare provider, pharmacy, laboratory, compounder, or telehealth service, and no content on the Service should be understood as a prescription or clinical recommendation.

We do not sell, supply, manufacture, prescribe, source, test, verify, or facilitate the purchase of any peptides, drugs, or other substances, and we do not endorse any specific protocol, product, vendor, supplier, laboratory, or dosage. Peptides and related compounds may be regulated, restricted, or illegal in your country or region, and many are not approved for human use.

You are solely responsible for your own health decisions and for complying with all laws that apply to you. Always consult a qualified, licensed healthcare professional before starting, stopping, or changing any protocol. You use the Service and rely on its content entirely at your own risk, and you knowingly and voluntarily assume all risks associated with that use, including risks of personal injury, illness, adverse reaction, or death.

PEP Social does not verify the legality, safety, purity, identity, effectiveness, or regulatory status of any substance, vendor, laboratory report, certificate of analysis, or claim discussed on the platform. Nothing on the platform is an endorsement or recommendation.

5. Your account

To use most features you must create an account. You agree to provide accurate information, keep it up to date, and keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly at support@pepsocialapp.com if you suspect unauthorized use.

PEP Social may reclaim, modify, or remove usernames that impersonate another person, infringe intellectual-property rights, violate these Terms, are offensive or misleading, or have been inactive for an extended period where necessary for the operation of the Service.

6. Our role: a platform, not a publisher

PEP Social is an interactive computer service that hosts content created by its users. We are a conduit and a host — not the author, publisher, or speaker of User Content. Content posted by users is their content and reflects their views, not ours.

Consistent with Section 230 of the Communications Decency Act (47 U.S.C. § 230) and any comparable law, we are not treated as the publisher or speaker of information provided by another information content provider, and we are not liable for any action voluntarily taken in good faith to restrict access to or availability of material we consider objectionable.

No obligation to monitor

We have no obligation to pre-screen, monitor, review, verify, fact-check, or edit User Content, and we do not do so exhaustively. Some content is reviewed automatically or manually, but that review is limited, imperfect, and entirely at our discretion.

Any monitoring or moderation we do perform is voluntary and does not create a duty to perform it, to perform it consistently, or to perform it at all in any other instance. The fact that content remains on the Service does not mean we have reviewed it, approved it, verified it, or agree with it.

You acknowledge that you may be exposed to content you find inaccurate, offensive, indecent, unsafe, or objectionable, and you agree that PEP Social has no liability to you for such content.

7. User content & license

You own your content. You retain all ownership rights in the User Content you create. By posting User Content, you grant PEP Social a non-exclusive, worldwide, royalty-free, sublicensable (solely to our service providers, such as hosting, video-encoding and content-delivery vendors) license to host, store, reproduce, modify, adapt, reformat, encode, publicly perform, publicly display, and distribute that content, and to create derivative works of it, solely to operate, provide, secure, and promote the Service (for example, showing your posts to other users in the feed). This license ends when you delete your content or your account, except for copies retained in routine backups, where required by law, or where the content has been shared by others and not deleted by them.

The rights to modify, reformat, encode and create derivative works exist for technical reasons only. Video must be converted into multiple sizes and formats so it plays smoothly on different devices and connections, and still images are taken from it for previews and thumbnails. We do not use these rights to edit the substance of what you posted, and we do not license your content to third parties for their own purposes.

We do not use your private content or personal information to train AI models.

Your representations. You are solely responsible for your User Content. You represent and warrant that you own or have all rights, licenses, consents, releases and permissions necessary to post it and to grant the license above; that it does not infringe or misappropriate anyone's copyright, trademark, publicity, privacy or other rights; and that it does not violate these Terms or any law.

If your User Content shows, names, or records another identifiable person, you must have that person's permission before posting it. This includes photographs and video of other people, including in gyms, clinics, and other private settings.

8. Music, audio & third-party material

If you post a video, you are responsible for everything contained in it, including all audio. You represent and warrant that you own or have obtained all necessary rights, licenses and clearances for every element of that video — the footage, any music or sound recording, any composition, any performance, any logo or artwork, and any other third-party material it contains.

PEP Social does not provide a music library and grants you no music rights whatsoever. We have no licensing arrangement with any record label, music publisher, artist, or performing-rights organization (such as ASCAP, BMI, SESAC, or SoundExchange), and we do not obtain, supply, or pay for any licence on your behalf. Any music you include in User Content must be music you are separately licensed or otherwise entitled to use.

Owning a copy of a song, having purchased it, having it playing nearby while you record, or having seen it used elsewhere on other platforms does not give you the right to publish it here. Rights that a different platform has obtained do not extend to PEP Social.

You are solely responsible for any claim arising from audio or other third-party material in your User Content, and you agree to indemnify us for such claims under Section 21.

We may, at our sole discretion and without notice or liability, mute the audio of, restrict, disable, or remove any User Content that we believe contains music or other material you are not entitled to use, and we may do so proactively or in response to a notice. Repeated violations may result in loss of posting access or termination of your account under our repeat-infringer policy in Section 22.

9. Content & conduct of other users

Other users' posts, comments, messages, profiles, recommendations, claims, and links are theirs. We do not adopt, endorse, verify, guarantee, or take responsibility for them, and you should not treat them as reliable, safe, lawful, or accurate.

Your dealings with other users are solely between you and them. This includes any conversation, transaction, purchase, exchange, referral, recommendation, arrangement, or meeting arising out of the Service, whether it occurs on the Service or elsewhere. PEP Social is not a party to and has no involvement in those dealings, does not screen users, and does not vet any vendor, supplier, source, laboratory, coach, or practitioner that a user may mention.

If a user directs you to an outside seller, website, group, or source of any kind, you deal with that party entirely at your own risk. We make no representation about them and we have no responsibility for what they sell, say, or do.

Verified creators, badges & creator codes

Some accounts display a verified creator badge. That badge is an access permission, not a recommendation. It indicates only that the account has been granted the ability to post video (Clips) on the Service. It is not an endorsement, sponsorship, certification, or approval of that person, their posts, their opinions, their protocols, their products, their business, or anyone they mention or link to. It is not a statement that they are qualified, medically trained, accurate, safe, or trustworthy, and it does not mean we have reviewed, verified, or agree with anything they say.

Verified creators are independent users. They are not employees, agents, partners, spokespeople, or representatives of PEP Social, LLC, and they have no authority to speak for us or to bind us. Everything a verified creator posts is their own User Content and is governed by this Section 9 and by Section 6 exactly like anyone else's.

The same applies to creator codes and referral codes. A code identifies who referred you to PEP Social and may earn that person a commission on subscriptions. It is a marketing arrangement for the app itself — nothing more. It is not an endorsement by us of that creator, and it is not an endorsement of any peptide, compound, protocol, vendor, supplier, or product that creator discusses anywhere, on or off the Service.

We may grant, decline, suspend, or withdraw a creator badge or a creator code at any time, at our sole discretion and without notice or liability.

Release. To the fullest extent permitted by law, you release PEP Social, LLC and its owners, members, officers, employees, contractors, agents and affiliates from any and all claims, demands, damages, losses, and liabilities of every kind — known or unknown, suspected or unsuspected, disclosed or undisclosed — arising out of or in any way connected with the content, conduct, acts or omissions of any other user or third party, whether online or offline.

If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any comparable provision of any other jurisdiction.

PEP Social is a social platform, and ordinary social and commercial speech is welcome. Subject to Section 10, you may:

Two conditions apply. First, if you have been paid or otherwise compensated, or you have a material connection to what you are promoting, you must disclose it clearly, as required by the FTC Endorsement Guides and comparable rules. Second, the line in Section 10 still holds: you may talk about sources and products, but you may not use PEP Social to transact in, broker, or arrange the supply of peptides or other regulated substances.

We do not verify, endorse, or take responsibility for any commercial claim, discount, affiliate arrangement, or promotion made by a user, and we are not a party to it. Any purchase you make as a result of content on the Service is between you and the seller.

12. Moderation & enforcement

We may, at our sole discretion, at any time, with or without notice, and without liability to you or anyone else, remove, restrict, hide, demote, age-restrict, mute, or disable any User Content, and suspend, limit, or terminate any account, for any reason or no reason — including content or conduct that we believe in our reasonable judgment harms the community, undermines the purpose of the Service, creates safety, legal, or regulatory concerns, or violates the spirit of these Terms, even if the specific conduct is not expressly listed above.

Equally, we are not liable for content we do not remove or for any decision not to act. We have no obligation to give reasons, to provide an appeal, or to treat similar cases identically, though we may choose to do so.

13. The AI assistant

The Service may include an AI assistant that generates responses automatically using third-party AI providers. AI responses are provided "as is" with no representations or warranties of any kind. They may be inaccurate, incomplete, outdated, misleading, or inappropriate, and should never be relied upon as medical, legal, financial, or other professional advice. We do not endorse AI-generated output. You remain solely responsible for any decisions you make and assume all risk arising from your use of the output. Always verify important information independently, and avoid submitting highly sensitive information to the AI assistant.

14. Subscriptions & billing

PEP Social is available on iOS via the Apple App Store. Some features are offered through an optional Premium subscription. Pricing and terms are shown at the point of purchase in your local currency.

15. Third-party services

The Service relies on third-party providers and may contain links to third-party websites or resources. These providers include infrastructure, authentication and storage vendors, video hosting and encoding vendors, AI providers, and the Apple App Store for distribution and payments.

We are not responsible for third-party services or content and do not endorse them. Your use of a third party's service is governed by that party's terms and privacy policy.

16. Intellectual property

The Service, including its software, design, logos, trademarks, and content we provide (but excluding User Content), is owned by PEP Social, LLC or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service except as permitted by these Terms. Nothing in these Terms transfers ownership of PEP Social's intellectual property to users.

Feedback. If you send us ideas, suggestions, or feedback about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use it for any purpose without obligation or compensation to you.

17. Termination

You may stop using the Service and delete your account directly within the app at any time. If you experience any issue deleting your account, you may contact us at support@pepsocialapp.com. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the Service.

Any provisions that by their nature should survive termination will survive, including Our role as a platform, the licenses you grant for User Content, Content & conduct of other users (including the release), Intellectual Property, Time limit for claims, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution & Arbitration, and Governing Law.

18. Time limit for claims

To the fullest extent permitted by law, any claim or cause of action arising out of or relating to these Terms or the Service must be filed within one (1) year after the date the event or facts giving rise to the claim occurred. Claims brought after that period are permanently barred.

19. Disclaimers ("as is")

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, timely, or error-free, that defects will be corrected, or that any content — including AI output, user posts, ratings, certificates of analysis, and vendor claims — is accurate, complete, reliable, lawful, or safe. No advice or information, whether oral or written, obtained from us or through the Service creates any warranty not expressly stated in these Terms.

20. Limitation of liability

To the fullest extent permitted by law, PEP Social, LLC and its owners, members, officers, employees, contractors, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, reputation, or health outcomes, arising out of or relating to the Service, whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
Without limiting the above, we are not liable for: personal injury, illness, adverse reaction, or death resulting from any substance, protocol, or decision discussed on or influenced by the Service; the content, conduct, acts or omissions of any user or third party; any transaction, purchase, or arrangement between you and another user or an outside seller; reliance on any post, rating, review, certificate of analysis, vendor claim, promotion, or AI output; interruption, suspension, or discontinuation of the Service; loss or unauthorized access to data or your account; content we removed, and content we did not remove.
Our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you; in that case our liability is limited to the greatest extent permitted by law.

21. Indemnification

You agree to defend, indemnify, and hold harmless PEP Social, LLC and its owners, members, officers, employees, contractors, agents, affiliates, and service providers from and against any claims, demands, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

We may assume the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense. This obligation survives termination of your account.

22. Copyright, DMCA & other IP notices

We respect intellectual-property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512).

Submitting a notice

To be effective, your notice must be in writing and include all of the following:

We may remove or disable access to the material while we review a claim, and we will make a reasonable effort to notify the person who posted it.

Counter-notification

If your content was removed and you believe that was a mistake or a misidentification, you may send a counter-notification to the agent above containing:

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the activity.

Repeat infringers

We will terminate the accounts of repeat infringers in appropriate circumstances. A user who is the subject of repeated valid infringement notices may lose posting access or have their account terminated without further warning.

Trademark, publicity & other rights

If you believe content on the Service infringes your trademark, or uses your name, image, likeness or voice without permission, contact support@pepsocialapp.com with a description of the content, its location, the right you hold, and your contact details. We review these reports and may remove content at our discretion.

Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages.

23. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. Subject to Section 24, the state and federal courts located in Virginia will have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction there.

24. Dispute resolution & arbitration

Informal resolution first. Most disputes can be resolved informally. Before filing a claim, you agree to contact us at support@pepsocialapp.com with a written description of the dispute and the relief you seek, and to try in good faith to resolve it for at least 30 days. This is a condition precedent to starting arbitration.

If we cannot resolve it, you and PEP Social agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court. Arbitration will take place in Virginia or your county of residence, and judgment on the award may be entered in any court with jurisdiction.

Class action waiver: you and PEP Social agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. You and PEP Social waive any right to a jury trial.

Mass filings. If 25 or more similar claims are asserted against us by or with the assistance of the same firm or coordinated group, the parties agree the claims will be resolved in batches of no more than 50, with a single arbitrator per batch, and the limitation period in Section 18 is tolled for claims awaiting their batch.

Severability. If the class-action waiver is found unenforceable as to a particular claim or remedy, that claim or remedy will be severed and heard in court, and the remainder of this section still applies to all other claims.

Opt-out: you may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@pepsocialapp.com with your name and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

We may add, remove, modify, discontinue, or suspend any feature or part of the Service at any time, with or without notice, and without liability to you.

27. Force majeure

PEP Social is not responsible for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, internet or network outages, cyberattacks, governmental actions, labor disputes, failures of third-party providers, or similar events.

28. Electronic communications

By creating an account and using the Service, you consent to receive communications from us electronically — including notices about your account, security, legal matters, and the operation of the Service — and you agree that such electronic communications satisfy any legal requirement that such communications be in writing.

29. General

If any provision of these Terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions remain in full effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates any partnership, joint venture, employment, agency, or fiduciary relationship between you and PEP Social. These Terms, together with the Privacy Policy, are the entire agreement between you and PEP Social regarding the Service.

30. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
